Millions of human biological samples are stored worldwide for medical research or treatment purposes. These biospecimens are of enormous potential value to law enforcement as DNA profiles can be obtained from these samples. However, forensic use of such biospecimens raises a number of ethical questions. This article aims to explore ethical issues of using human bodily material in medical biobanks for crime investigation and prosecution purposes. Concerns about confidentiality, trust, autonomy and justice will be discussed. We explore how to balance (...) these concerns against the importance of crime solving. Relevant case examples of forensic use of medical biobanks show that requests by law enforcement to access biobanks are handled in disparate ways. We identify some core ethical issues and conclude that further research on these issues is needed to provide ethical guidance. (shrink)

Over 30 million people worldwide have taken a commercial at-home DNA test, because they were interested in their genetic ancestry, disease predisposition or inherited traits. Yet, these consumer DNA data are also increasingly used for a very different purpose: to identify suspects in criminal investigations. By matching a suspect’s DNA with DNA from a suspect’s distant relatives who have taken a commercial at-home DNA test, law enforcement can zero in on a perpetrator. Such forensic use of consumer DNA data has (...) been performed in over 200 criminal investigations. However, this practice of so-called investigative genetic genealogy raises ethical concerns. In this paper, we aim to broaden the bioethical analysis on IGG by showing the limitations of an individual-based model. We discuss two concerns central in the debate: privacy and informed consent. However, we argue that IGG raises pressing ethical concerns that extend beyond these individual-focused issues. The very nature of the genetic information entails that relatives may also be affected by the individual customer’s choices. In this respect, we explore to what extent the ethical approach in the biomedical genetic context on consent and consequences for relatives can be helpful for the debate on IGG. We argue that an individual-based model has significant limitations in an IGG context. The ethical debate is further complicated by the international, transgenerational and commercial nature of IGG. We conclude that IGG should not only be approached as an individual but also—and perhaps primarily—as a collective issue. There are no data in this work. (shrink)

An innovative, multifaceted approach to scientific experiments as designed by and shaped through interaction with the modeling process The role of scientific modeling in mediation between theories and phenomena is a critical topic within the philosophy of science, touching on issues from climate modeling to synthetic models in biology, high energy particle physics, and cognitive sciences. Offering a radically new conception of the role of data in the scientific modeling process as well as a new awareness of the problematic aspects (...) of data, this cutting-edge volume offers a multifaceted view on experiments as designed and shaped in interaction with the modeling process. Contributors address such issues as the construction of models in conjunction with scientific experimentation; the status of measurement and the function of experiment in the identification of relevant parameters; how the phenomena under study are reconceived when accounted for by a model; and the interplay between experimenting, modeling, and simulation when results do not mesh. Highlighting the mediating role of models and the model-dependence of data measurement, this volume proposes a normative and conceptual innovation in scientific modeling--that the phenomena to be investigated and modeled must not be precisely identified at the start but specified during the course of the interactions arising between experimental and modeling activities. Experimental modeling is the construction of theoretical models hand in hand with experimental activity. As explained in Section 1, experimental modeling starts with claims about phenomena that use abstract concepts, concepts whose conditions of realization are not yet specified; and it ends with a concrete model of the phenomenon, a model that can be tested against data. This paper argues that this process from abstract concepts to concrete models involves judgments of relevance, which are irreducibly normative. In Section 2, we (...) show, on the basis of several case studies, how these judgments contribute to the determination of the conditions of realization of the abstract concepts and, at the same time, of the quantities that characterize the phenomenon under study. Then, in Section 3, we compare this view on modeling with other approaches that also have acknowledged the role of relevance judgments in science. To conclude, in Section 4, we discuss the possibility of a plurality of relevance judgments and introduce a distinction between locally and generally relevant factors. (shrink)

Patients in a vegetative state/ unresponsive wakefulness syndrome (VS/UWS) pose ethical dilemmas to those involved. Many conflicts occur between professionals and families of these patients. In the Netherlands physicians are supposed to withdraw life sustaining treatment once recovery is not to be expected. Yet these patients have shown to survive sometimes for decades. The role of the families is thought to be important. The aim of this study was to make an inventory of the professional perspective on conflicts in long-term (...) care of patients in VS/UWS. A qualitative study of transcripts on 2 Moral Deliberations (MD’s) in 2 cases of patients in VS/UWS in long-term care facilities. Six themes emerged: 1) Vision on VS/UWS; 2) Treatment and care plan; 3) Impact on relationships; 4) Feelings/attitude; 5) Communication; 6) Organizational aspects. These themes are related to professionals and to what families had expressed to the professionals. We found conflicts as well as contradictory feelings and thoughts to be a general feature in 4 of these themes, both in professionals and families. Conflicts were found in several actors: within families concerning all 6 themes, in nurse teams concerning the theme treatment and care plan, and between physicians concerning all 6 themes. Different visions, different expectations and hope on recovery, deviating goals and contradictory feelings/thoughts in families and professionals can lead to conflicts over a patient with VS/UWS. Key factors to prevent or solve such conflicts are a carefully established diagnosis, clarity upon visions, uniformity in treatment goals and plans, an open and empathic communication, expertise and understanding the importance of contradictory feelings/thoughts. Management should bridge conflicts and support their staff, by developing expertise, by creating stability and by facilitating medical ethical discourses. Shared compassion for the patient might be a key to gain trust and bridge the differences from non-shared to shared decision making. (shrink)

Colour has been shown to facilitate the recognition of scene images, but only when these images contain natural scenes, for which colour is ‘diagnostic’. Here we investigate whether colour can also facilitate memory for scene images, and whether this would hold for natural scenes in particular. In the first experiment participants first studied a set of colour and greyscale natural and man-made scene images. Next, the same images were presented, randomly mixed with a different set. Participants were asked to indicate (...) whether they had seen the images during the study phase. Surprisingly, performance was better for greyscale than for coloured images, and this difference is due to the higher false alarm rate for both natural and man-made coloured scenes. We hypothesized that this increase in false alarm rate was due to a shift from scrutinizing details of the image to recognition of the gist of the image. A second experiment, utilizing images without a nameable gist, confirmed this hypothesis as participants now performed equally on greyscale and coloured images. In the final experiment we specifically targeted the more detail-based perception and recognition for greyscale images versus the more gist-based perception and recognition for coloured images with a change detection paradigm. The results show that changes to images are detected faster when image-pairs were presented in greyscale than in colour. This counterintuitive result held for both natural and man-made scenes and thus corroborates the shift from more detailed processing of images in greyscale to more gist-based processing of coloured images. The subtitle of this text intended for philosophy students’ 2nd course in logic is in no way misleading. It is a lucid introduction to the philosophic activities of uncovering metaphysical presuppositions of logical techniques and altering logical techniques, and hence assessments of deductive validity, to conform to metaphysical presuppositions. They do not, though, assume that techniques for assessing deductive validity are or should be wholly dependent upon metaphysical presuppositions. They write on p. 213 in their section on intensional discourse: "And (...) logic wherever possible ought not to wait upon philosophy, for logic wherever possible ought to be neutral between different philosophical analyses." In their investigations of metaphysical presuppositions and logical techniques, they consider primarily the consequences of existential presuppositions about the use of singular terms, viz., individual variables, individual names, and definite descriptions. They favor freeing use of singular terms from existential presuppositions. The consideration of allowing non-referring names and definite descriptions makes their text one of the first, if not the first, for teaching Free Logic. The gist of Free Logic is not to allow existential generalization of Fb to unless there is an auxiliary premise asserting the existence of b, because use of the name b has been freed from the presupposition that it names something. It is suitable that these authors have a text on Free Logic since Lambert is the major figure in its origin while van Fraassen has established some of the most significant results about Free Logic systems. They go on to consider alternative logical rules to those of Russell for dealing with nonreferring definite descriptions. These alternatives to standard logic are philosophically motivated. They are not simply dumped upon students as rules for symbol manipulation. For instance, on pp. 152-157 they give a succinct analysis of the Russell-Meinong debate when they agree with Meinong that one can talk of the thing that is such and such without accepting that there is such a thing. The treatment of singular terms leads them to discussions of topics such as: What is it for a logic to be extensional and is Free Logic extensional?, the substitution interpretation of quantifiers, and the notion of presupposition. The title of this and proposed second volume presents the basic idea which unifies the wide variety of topics developed and investigated by the principal authors, major contributing authors, J. M. Dunn and Robert K. Meyer, and eleven other contributors. The other contributors are: J. R. Chidgey, J. A. Coffa, Dorthy L. Grover, Bas van Fraassen, H. Leblanc, Storrs McCall, A. Parks, G. Pottinger, R. Routley, A. Urquhart, and R. G. Wolf. From both the useful analytic table of contents and (...) from the section titles it is clear which contributing author has written each section. Chapter I, "The Pure Calculus of Entailment," suggests how logics of entailment are logics of relevance and necessity. When we explain why a large number of systems are investigated, it will be clear why we write of logics of entailment instead of the logic of entailment. The principal authors build a case in Chapter I, and elsewhere, that a genuinely valid formal inference, viz., a formal entailment, from a formula A to a formula B requires that A be relevant to B in addition to it being impossible that there be an interpretation making A true and B false. So, a claim that A entails B tells us, explicitly or implicitly, that A is relevant to B and that "if A then B" is necessarily true, i.e., A strictly implies B. Consequently since a logic of entailment presents allegedly unfalsifiable claims, i.e., theses, using entailment claims, a logic of entailment presents theses about relevance between antecedents and consequents and necessity. It should be noted that the systems of logic developed are for formal entailments; they may not be logics for material entailments such as: being a cube entails having six surfaces. (shrink)

Van Peursen’s book is an authorized translation and is published under the auspices of the Duquesne Philosophical Series. The purpose of the work is to effect a rapprochement between two of today’s most notable approaches to philosophy: phenomenology and linguistic analysis. These respective philosophical methods are frequently looked upon as two of the conspicuous polar trends within contemporary philosophy, and the author arranges their confrontation in such a way that their most fundamental convergencies and divergencies are revealed. The original phase (...) of phenomenology, that of Edmund Husserl, and the earlier phase of logical positivism as represented by Carnap and Schlick, are described by focusing on their treatment of the problem of meaning. A further comparison is made between the respective ways phenomenological reduction and analytical reduction treat the question of factual existence. Both philosophical methods are presented clearly and sympathetically in their historical depth and with emphasis on their methodological aspects. The author then makes a provisional confrontation between them which centers on the critical problem of defining the appropriate relation between operational and intuitive meaning, the truths of reason and the truths of fact. These two methods of philosophy stem from essentially different attitudes whose significance transcends the limits of philosophy, and one of Van Peursen’s purposes is to explain both schools of thought to a wider public. He then traces the further development of phenomenology through the later Husserl and Merleau-Ponty, while concentrating on the phenomenology of the ego and of the Life-World. This analysis is followed by a description of the movement from logical positivism to analytical philosophy as it was shaped by the linguistic orientation of Wittgenstein and Ryle. The last chapter offers a final confrontation between the transcendental and the linguistic approaches. (shrink)

SummaryIntense, sustained nursing lengthens inter-birth intervals and is causally linked with low natural fertility. However, in traditional settings, the effects of such nursing on fertility are difficult to disentangle from those of nutrition. Results from an prospective, direct observational study of reproductive function in well-nourished Amele women who nurse intensively and persistently but who also have high fertility are here presented. Endocrine measures show that ovarian activity resumes by median 11·0 months postpartum. Median duration of postpartum amenorrhoea is 11·3 months, (...) time to next conception is 19·0 months, and the inter-birth interval is 28·0 months. Average life time fertility is 6·8. High fertility in Amele women is due both to refractoriness of reproductive function to suckling stimuli, and to maintenance of equivalent age-specific fertility rates across the reproductive life span.
